Terms of Use for Bound

1. Provider and scope

I, Chen Yang Diep, independently develop and operate Bound:

These Terms govern your use of the Bound iOS app, its associated backend services, and Bound invitation links. By creating a Bound account or using the service, you agree to these Terms.

2. Eligibility

You must be at least 16 years old to use Bound. If you are under the age of legal majority where you live, you may use Bound only with the permission of a parent or legal guardian where that permission is required by law.

You may use Bound only if you can legally enter into this agreement and are not prohibited from receiving the service under applicable law.

3. Your account

Bound uses Sign in with Apple. Your account is personal to you. You must keep access to your Apple Account and device secure, provide a display name that you are entitled to use, and notify me if you believe that your Bound account has been accessed without permission.

You are responsible for activity carried out through your account to the extent that it results from your acts or omissions. You may not impersonate another person, create an account for someone else without authority, or transfer your account to another person.

4. What Bound provides

Bound is a voluntary accountability service. Depending on the permissions and features you choose, it can help you:

Bound carries out settings and decisions made by users. I do not monitor your relationships, decide which limits are appropriate, or act as a guardian, supervisor, counsellor, or mediator between connected users.

5. Trusted relationships and voluntary use

Only connect with a person you know and trust. Before inviting, connecting, or managing settings for another person, you must have their permission and any other authority required by law.

You must not use Bound to coerce, threaten, harass, deceive, punish, or unlawfully monitor another person. Each participant is responsible for deciding whether to create, continue, or end a trusted relationship. Ending a relationship may stop future management access, but it does not undo actions already performed on a device or immediately erase every record subject to the retention periods in the Privacy Policy.

6. Screen Time and technical limitations

Bound depends on your device, iOS, Apple's Screen Time frameworks, system permissions, background execution, notifications, network access, and external services. These systems may delay, interrupt, override, or prevent a feature from working. Operating-system updates, permission changes, device restoration, reinstallation, connectivity problems, or other software can also affect limits and shields.

You remain responsible for checking important settings. Bound is not designed as an emergency, medical, safety-critical, or legally required supervision system. I do not promise that a limit, shield, notification, or request will be available or enforced at every moment.

Nothing in this section limits statutory rights that cannot lawfully be excluded.

7. NFC tags

Use only NFC tags and locations that you own or are authorised to use. You are responsible for the physical security, placement, and continued availability of your tag. A lost, damaged, rewritten, or accessible tag may prevent intended use or allow another person with physical access to scan it.

Do not place a tag where scanning it would be unsafe, unlawful, or disruptive. Bound's emergency unlock workflow depends on device and network availability and is not an emergency service.

You may provide content such as a display name and an optional reason for a request. You retain your rights in that content and are responsible for it. You must have the necessary rights to provide it, and it must not be unlawful, misleading, abusive, or infringe another person's rights.

You grant me a limited, non-exclusive licence to host, process, transmit, and display that content only as necessary to operate and secure Bound. This licence ends when the content is deleted, except to the extent that temporary backups or legal retention duties apply.

I may restrict or remove content where reasonably necessary to protect users, operate the service, comply with law, or enforce these Terms.

10. Fees and future paid features

Bound is currently provided free of charge and does not currently offer an in-app purchase or subscription.

I may offer optional paid features in the future. I will disclose the price, billing period, renewal conditions, cancellation method, and other required terms before you buy them. Your existing use will not automatically become paid, and you will not be charged without an explicit purchase or other valid authorisation. These Terms will be updated before paid features are introduced.

11. Availability, updates, and changes to the service

I may maintain, update, improve, limit, or discontinue features for technical, security, legal, or operational reasons. I do not promise that every feature will remain available in every country, on every device, or with every iOS version.

Where reasonably possible, I will give appropriate notice before a material change that adversely affects the service. Mandatory update, conformity, consumer, and termination rights under applicable law remain unaffected.

12. Apple and other services

Your use of the iOS app is also subject to the applicable Apple Media Services Terms and Apple's Standard Licensed Application End User License Agreement. The Apple licence governs the licence to the app; these Terms govern the Bound service and your relationship with me.

Apple, Supabase, Cloudflare, telecommunications providers, and other external services operate under their own terms. I am responsible for Bound, not Apple. Apple has no obligation to provide maintenance or support for Bound.

13. Intellectual property

Bound, including its software, design, branding, text, and other original materials, is protected by intellectual-property laws. Except for the limited right to use Bound under these Terms and the applicable Apple licence, no rights are transferred to you.

Third-party and open-source materials remain subject to their respective terms.

14. Privacy

The Privacy Policy explains how I process personal data in connection with Bound. It forms a separate notice and does not reduce any right you have under applicable data-protection law.

15. Suspension, termination, and account deletion

You may stop using Bound at any time and can delete your account from within the app. Account deletion is permanent and affects connected relationships, shared settings, requests, and locally configured protections as described in the app and Privacy Policy.

I may temporarily restrict or terminate access where reasonably necessary to address a material breach of these Terms, protect users or the service, comply with law, or respond to a serious security risk. Where appropriate and legally permitted, I will provide notice and a reasonable opportunity to remedy the issue.

16. Statutory rights, warranty, and liability

Your mandatory statutory rights, including applicable rights relating to digital products and consumer protection, remain unaffected.

I am liable without limitation for intent and gross negligence, for injury to life, body, or health caused intentionally or negligently, under applicable product-liability law, and wherever liability cannot legally be limited.

For slight negligence affecting an essential contractual obligation, liability is limited to damage that was foreseeable and typical when the agreement was made. An essential obligation is one whose performance is necessary for the proper operation of the agreement and on which you may ordinarily rely. To the extent permitted by law, liability for other cases of slight negligence is excluded.

17. Governing law and disputes

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your usual country of residence.

I am neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. This does not restrict your right to bring a claim before a competent court.

18. Changes to these Terms

I may update these Terms when Bound's features, business model, providers, or legal requirements change. I will publish the revised Terms with a new “Last updated” date. For material changes affecting existing users, I will provide appropriate notice and, where required, request renewed acceptance before the change takes effect.
